Terms and Conditions of the "CardSwapr" Mobile Application

Definitions

1. Application: The "CardSwapr" mobile application designed for the exchange of collectible cards between users.
2. User: A natural person who has registered an account and uses the Application.
3. User Account: An individual account created by the User in the Application.
4. Collectible Cards: Items of exchange offered by Users in the Application.
5. Administrator: piotrfeder.pl - Piotr Feder, with its registered office at 96-300 Żyrardów, ul. Sowińskiego 13/9, Poland, the owner and operator of the Application.
6. Terms and Conditions: This document defining the rules for using the Application.

Registration and User Account

1. To use the full functionality of the Application, the User is required to register a User Account.
2. During registration, the User will be asked to provide the following data: e-mail address.
3. It is the User's responsibility to provide true and current data.
4. The User may additionally provide their city of residence and country for easier matching of results (users who have cards for exchange).
5. The User is responsible for maintaining the confidentiality of their access password to the User Account.
6. Creating multiple User Accounts by one person is prohibited.
7. The Administrator reserves the right to block or delete a User Account in case of violation of these Terms and Conditions or suspicion of fraudulent activities.

Rules of Using the Application

1. The Application is used for the exchange of Collectible Cards between Users.
2. Users can browse profiles of other Users based on the provided Country and City to find potential exchange partners.
3. Users can contact each other through the communication tools available in the Application to agree on the terms of the exchange.
4. The User is solely responsible for the content of their exchange offers, descriptions of Collectible Cards, and communication with other Users.
5. Publishing content that is illegal, offensive, vulgar, infringing on copyrights or personal rights of others is prohibited.
6. Using the Application for commercial purposes other than the exchange of Collectible Cards (e.g., advertising, sales) is prohibited.
7. Taking actions aimed at disrupting the operation of the Application or gaining unauthorized access to data of other Users is prohibited.

Exchange of Collectible Cards

1. All arrangements regarding the exchange of Collectible Cards are made directly between the Users.
2. The Administrator is not responsible for the course and outcome of exchanges, including the quality, authenticity, and delivery of the exchanged Collectible Cards.
3. Users should exercise caution and verify the credibility of other Users before making an exchange.
4. The Administrator does not mediate in disputes between Users regarding exchanges.

Personal Data and Privacy

1. The rules regarding the collection, processing, and protection of Users' personal data are defined in the Application's Privacy Policy, available in the application -> Profile -> Link or on the application's website.
2. By using the Application, the User agrees to the processing of their personal data in accordance with the Privacy Policy.
3. The Application uses Google Analytics and Facebook Business Manager to collect anonymous information about how the Application is used in order to improve it.
4. The Application displays advertisements provided by Google AdMob. The rules regarding the display of advertisements and the use of data for this purpose are defined in Google's privacy policies.
5. The Application is based on Google's Firebase platform, which may process User data to ensure the Application's functionality and security. Detailed information on data processing by Firebase can be found in Google's privacy policy.
6. The application uses the Facebook SDK for user login/registration, which may process User data to ensure the functionality and security of the Application. Detailed information on data processing by Facebook can be found in Facebook's privacy policy.

Intellectual Property

1. All rights to the Application, including copyrights to the code, graphics, user interface, and content provided by the Administrator, belong to the Administrator or its licensors.
2. Users may use the Application only in a manner consistent with these Terms and Conditions and within the scope of its functionality.
3. Copying, modifying, distributing, or otherwise using the content and elements of the Application without the Administrator's consent is prohibited.
4. Users retain rights to the content (descriptions of Collectible Cards, photos) published by them in the Application, but grant the Administrator a non-exclusive, royalty-free license to use them to the extent necessary for the Application's operation (e.g., displaying them to other Users).
5. All trademarks belong to their respective owners, and the names of card manufacturing companies are for informational purposes only.

Liability

1. The Administrator makes every effort to ensure the proper functioning of the Application, but does not guarantee its uninterrupted and error-free availability.

2. The Administrator is not liable for:

   • Actions of Users in the Application, including the content of their offers and communication.
   • Damages resulting from improper use of the Application.
   • Unavailability of the Application due to technical or other reasons beyond the Administrator's control.
   • The content of advertisements displayed in the Application by Google AdMob.
   • The consequences of exchanges of Collectible Cards between Users.

Changes to the Terms and Conditions

1. The Administrator reserves the right to change these Terms and Conditions at any time.
2. All changes to the Terms and Conditions will be published in the Application or in another manner accessible to Users (e.g., via push notification, email messages).
3. Changes to the Terms and Conditions come into effect on the date of their publication.
4. Continued use of the Application after the introduction of changes to the Terms and Conditions constitutes acceptance of these changes by the User.

Dispute Resolution

1. Any disputes arising from the use of the Application will be resolved through negotiations between the User and the Administrator.
2. In the event of no agreement, the dispute may be submitted for resolution to the competent common court in accordance with applicable legal regulations.
